Purchaser understands and agrees that VENDOR is not responsible or liable for damage to equipment OR PERSONS caused by the use of our products.  purchaser understands that it uses products at its own risk and AS a Condition precedent to purchasing from vendor agrees to fully and completely release, indemnify, defend, and hold harmless VENDOR
from any and all claims arising from the use of products or services provided by VENDOR.  This includes damage to patients caused during examination as well as damage to machinery in which products are installed. 

 

 

 

UNLESS SPECIFICALLY SET FORTH HEREIN, VENDOR MAKES NO REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT ANY PRODUCTS SOLD OR DISTRIBUTED BY VENDOR AND VENDOR SPECIFICALLY DISCLAIMS ANY LIABILITY FOR DIRECT, INDIRECT, CONSEQUENTIAL, PUNITIVE, OR SPECIAL DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST DATA, LOST REVENUE, LOST PROFITS, COST OF REPLACEMENT PARTS AND ANY AND ALL COSTS ARISING OUT OF THE PURCHASE, USE, OR PERFORMANCE OF VENDOR’S PRODUCTS UNDER ANY THEORY OF LIABILITY, EVEN IF THE DAMAGES COMPLAINED OF ARISE FROM VENDOR’S NEGLIGENCE.

VENDOR DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND DISCLAIMS ANY IMPLIED WARRANTY ARISING FROM A COURSE OF PERFORMANCE, DEALING, USAGE, OR TRADE PRACTICE.   

 

 

 

Purchaser also agrees that the substantive and procedural laws of the state of Illinois shall govern any disputes arising out of or relating to use of this website, purchasing or service of endoscopes or endoscope parts in any way and any litigation shall be VENUED SOLELY in the federal OR state courts Of will county, illinois.

Purchaser must be a Qualified Facility, and/or Endoscope Repair Technician to purchase parts used on Medical ( Human ) Endoscopy Equipment.

MANUFACTURERS PARTS SPECIFICATIONS, AND THEY ARE RESPONSIBLE FOR THESE CLAIMS.  WE RECOMMEND THAT YOU INDEPENDENTLY EVALUATE THE CLAIMS OF THESE MANUFACTURERS BEFORE PURCHASING.  YOU MAY ALSO PURCHASE USED O.E.M PARTS FROM US.

We would like to remind you to CLEAN and DISINFECT (sterilize) as recommended by the manufacturer, any and all instruments in accordance with the manufacturers instruction manual or reprocessing guide.
